After a 9th DUI conviction in just 12 years, a San Francisco driver may see up to 7 years in prison.
43-year-old Reynaldo Esquivel pleaded no contest to this final charge on Wednesday. When he was arrested in December, Esquivel provided a breath test sample showing his BAC to be .25 percent, more than three times the legal limit of .08 percent and enough to result in both extreme impairment and increased penalties.
As a result of his 9th DUI conviction, Esquivel's license is in jeopardy. The California Assembly approved a bill just recently to allow judges to revoke licenses permanently for 10 full years - a large extension over the current three-year penalty.
Unfortunately, Esquivel's defense attorney points out a key point to the San Mateo County Times : this measure may not stop repeat offenders like his client from driving. These individuals are more likely suffering from an addiction that will not be stopped through legal measure alone. As a result of their severe drinking problems, they will potentially continue to get behind the wheel, even without a license.
